Bait Digging

hi mate i dont think you know what you are talking about it took 5hr of evedence before he made up his mind if you look it up you will find 3yr befor my case a case went to the court of apeal and a high court judge over ruled the original verduct this was the bases of my defence so dont tell me he couldnt be bothered to do his job
 
mate - if you look at my other posts i end up agreeing with you...the law itself is true, it exists and the evidence is contained in the links I posted

My initial beef was the reference to the Magna Carter...which was, and still is (IMHO) a very vague connection to modern law

totally agree with you codfarther.
the magne carthe being ancient as it is gives the angler thew right to fish thus giving him the right to collect bait to fish with.
the only person/people in regards to illegal/legal tresspas on the beach in question is the council whom erected the signs.#
the reason behind this was the fishermen/boatmen of boulmer,regarding the safety of themselves and there property.
got to admit give them a bit of space to get to and from there place of work ( the boat via the beach. )
the only thing that may indicate the magne carta is if they decide to call the site a site of scientific interest, an sssi site just like the buddle bay one.
but have to admit digging there last year and the year befoe and it was sh@t.
you have to thin thew area out so =the worms can grow and breed just like boulmer.
well you guessed buddle bay is full of small worms that cannot grow due to the fackt no one actually thins them out exept the birds.and they have a job at it,
just look at boulmer soon as you leave the area you dug the birds are there for the pickings.
 
Thanks for the info on the bye law not being enforceable. I don't know the area that well but thought the out of bounds area was the part that digging and not backfilling could cause a danger to boat owners and therefore people shouldn't be digging there anyway.

Codfather, did you take them to court to challenge the bye law on a matter of principal or were you defending yourself against a case brought against you?
 
I remember the court case and all the publicity surrounding boulmer and budle bay. I dont dig my bait anymore, and when i did it was at the middens. I think most diggers have respect for the boatmen, and stay away from the moorings I also believe our bait collecting/fishing rights are enshrined in the Magna Carta and it was the likes of Codfather who stuck up for them........codfather ....wallsendo is being his usual self and getting as much info for the lads on site.. :)

There's more than enough modern laws out there that would put paid to the magna carta defence if someone really wanted to screw with you

according to magna carta its still perfectly legal to murder a scotsman withing the city walls of york as long as he's carrying a bow

anyone fancy inviting alex ferguson to york for the day and giving him a bow and arrow as a present??

if there's 3 or more of you together - anywhere, regardless of what your doing the criminal justice act makes that an unlawful assembly

depending what land you crossed to get to the beach you may have committed criminal trespass

try digging on budle bay and claim the magna carta defence! as an SSSI there's a huge number of environmental laws you have broken

all I'm saying to anyone thinking on relying on Magna Carta as a defence... don't! If it works fantastic, but in this country these days, don't rely on having any rights at all!

as for thinning worms out... not sure if thats right or not. there's 2 beaches I dig that are thick with them (white rag, king rag,blow, blacks, yellowtails) hundreds per square metre and turns up some of the biggest worms I've ever seen

So in theory - if there is 3 diggers on the beach ,the magna carter could be used Against them :eek:

As Bri said - that was a bite and a half...wasn't getting personal, but when someone starts quoting 800 year old laws at us without any kind of substance I personally want to know more
